1. Agreement to these terms

These Terms of Service (“Terms”) govern your use of MindPal and its related website, chat, voice, memory, and cloud features (collectively, the “Service”). By using the Service, you agree to these Terms and to the Privacy Policy.

If you do not agree, do not use the Service. If you use MindPal on behalf of an organization, you confirm that you have authority to accept these Terms for that organization.

2. The MindPal service

MindPal is an AI-powered reflection and support tool. It can generate conversational responses, help organize thoughts, offer general information, support journaling, accept voice input when available, and maintain optional memory or cloud-synced information when you choose to use those features.

MindPal’s responses are generated by automated systems. They may be incomplete, inaccurate, unsuitable for your circumstances, or unavailable. You are responsible for evaluating outputs before relying on them and for seeking qualified professional help when needed.

3. Safety and health boundaries

MindPal is not a crisis service and is not a substitute for a doctor, therapist, mental-health professional, emergency responder, lawyer, accountant, or financial adviser. Do not use MindPal as your only source of help in an emergency or to make decisions that require professional judgment.

If your conversation suggests immediate risk of harm, MindPal may present a safety-focused response that encourages you to contact local emergency services, a crisis resource, or a trusted person. This feature is not a guarantee that MindPal will detect every risk or provide the correct response in every situation.

4. Accounts and cloud data

You may be able to use MindPal in Local Mode without creating an account. Cloud features require a supported sign-in method. You are responsible for keeping your account credentials secure and for activity that occurs through your account.

When you use Cloud Mode, MindPal may synchronize your chats, memory, profile information, and selected settings across devices. You can manage available cloud data and account options in the Service. You may sign out or use the provided account deletion flow when available.

Do not share access to your account with anyone you do not authorize. Tell us through the support channel in the Service if you believe your account has been accessed without permission.

5. Acceptable use

You may use MindPal only in a lawful, responsible way. You must not use the Service to:

  • break the law, violate another person’s rights, or deceive, defraud, harass, or threaten anyone;
  • seek, create, or distribute content that promotes self-harm, violence, exploitation, abuse, or other serious harm;
  • attempt to access accounts, data, systems, or security controls without authorization;
  • interfere with, overload, reverse engineer, scrape, or disrupt the Service except where applicable law permits it;
  • upload or transmit malware, harmful code, or content that you do not have the right to share; or
  • use MindPal to make automated high-impact decisions about people, including decisions about health care, employment, housing, credit, education, insurance, or legal rights.

6. Your content and AI output

You retain any rights you have in the content you submit to MindPal. You grant MindPal a limited, non-exclusive right to process that content only as necessary to operate, secure, and improve the Service in line with the Privacy Policy.

You are responsible for the content you submit and for your use of AI-generated output. Do not submit content that you do not have permission to provide. AI output may resemble content generated for other users or may be similar to material found elsewhere; it is not guaranteed to be unique or fit for a particular purpose.

7. Availability, updates, and feedback

We may update, change, suspend, or discontinue any part of MindPal to maintain security, improve quality, comply with law, or evolve the Service. We do not guarantee uninterrupted or error-free availability.

If you provide feedback, ideas, or suggestions, you allow MindPal to use them without restriction or compensation, while respecting the privacy commitments described in the Privacy Policy.

8. Disclaimers and limitation of liability

To the maximum extent permitted by law, MindPal is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. This includes no warranty that the Service will be uninterrupted, secure, error-free, accurate, or suitable for your particular needs.

To the maximum extent permitted by law, MindPal and its operators, providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from your use of the Service. Nothing in these Terms limits liability that cannot legally be limited.

9. Suspension, termination, and changes to these terms

We may suspend or terminate access to MindPal if we reasonably believe that you have violated these Terms, created a security risk, or used the Service in a way that may harm others or the Service. You may stop using MindPal at any time and use the available account controls to delete your cloud account where applicable.

We may revise these Terms as the Service or legal requirements change. The revised version will be posted here with an updated “Last updated” date. Your continued use after the effective date of updated Terms means that you accept them, where permitted by law.

10. Contact

For questions about these Terms, use the support or contact channel made available within the MindPal service. If MindPal publishes a dedicated legal contact address, it will be listed on this page.
